1. Contest period: The Wisconsin Travel Best Bets Talkin’ Wisco Accent Contest (the “Promotion”) begins at 12:00 a.m. Central Time (“CT”) on May 5, 2014, and ends at 11:59:59 p.m. CT on June 27, 2014 (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for this Contest.
2. Eligibility: Must be 21 years of age or older as of date of entry. Employees, contractors, directors and officers, and vendors of Wisconsin Travel Best Bets (“Sponsor”), its affiliated entities, advertising and fulfillment agencies involved in the administration, development, fulfillment and execution of this Promotion (collectively, “Promotion Parties”), and the immediate family members of each (spouse, domestic partner, parent, child, sibling, grandparent, grandchild, and “step” of each) and those living in the same households of such people are not eligible to participate.
3. Agreement to Official Rules: Participation the Promotion constitutes entrant’s full and unconditional agreement to acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
4. How to Enter: During the Promotion Period, you may enter in the following way: follow @WIBestBets on Twitter or @witravelbestbets on Instagram and upload a video to the Twitter or Instagram app. Uploaded video must be tagged with #talkinwisco and either the @WIBestBets or @witravelbestbets tag, depending on platform. All entries must be completed and submitted by 11:59:59 p.m. CT on June 27, 2014, to be eligible to win. Normal Internet access and usage charges imposed by Entrants’ online service provider will apply. Unlimited entry per person per Contest Period.
5. Winner Selection: Three (3) winners will be chosen out of all eligible entries on or about July 9, 2014. The grand-prize winner will be decided by a panel of judges appointed by Wisconsin Travel Best Bets. Entries will be judged on the following criteria:
50% - Creativity
50% - Video quality
Two runner-up entries also will be selected at random from all eligible entries.
The Sponsor will attempt to notify the potential winners via Instagram or Twitter immediately following the winner selection. If the potential winners do not respond within 24 hours after the first attempt to contact him/her, the Sponsor will select alternate potential winners in his/her place from all eligible entries received. Winner must provide a mailing address in order to be eligible to receive the prize.
6. Prizes: One (1) Grand Prize winner will receive a $500 prepaid credit card. Two runners-up will each receive a $250 prepaid credit card. Total Approximate Retail Value (ARV) of all prizes: $1,000.
One prize per person maximum in this Promotion. No transfer or substitution of prizes permitted except where required by law. If a prize becomes unavailable, Sponsor may award a substitute prize of equal or greater value. Odds of winning a prize depend upon the number of eligible entries received. Taxes on a prize and expenses related to acceptance, delivery and use of a prize, are the sole responsibility of the applicable Prize Winner.
7. Publicity: Except where prohibited by law, each prize winner further grants to the Sponsor and those acting under its authority the right to use such prize winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Promotion, in any and all media, whether now known or hereinafter invented, without territorial or time limitations and without further consideration. Each prize winner further agrees that Sponsor may release his or her name to persons requesting the names of the winners of the Promotion. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
Except if winner is a resident of TN, or where prohibited by law, by accepting prize, winner grants permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
8. General Conditions: No cash equivalent or substitution of any Prize is offered, except at the sole discretion of the Sponsor. Prizes are non-transferable, non-refundable and have no cash value. By participating in this Promotion, entrants agree to these Official Rules and Sponsor’s Privacy Policy (available at http://witravelbestbets.com/internet-and-personal-information-privacy-policy/), which are final and binding in all respects. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to cancel, modify or terminate the Promotion and/or to disqualify any individual who tampers with the entry or drawing process or violates the Official Rules. This Promotion is governed by the laws of the state of Wisconsin, and participants agree that venue with respect to any dispute will be in Madison, Wisconsin, and all claims must be resolved in the federal or state courts located in Madison, Wisconsin. In the event of a dispute regarding the identity of an entrant who has been selected in a random drawing as a tentative prize winner, the entry at issue will be declared to have been made by the “Assigned Account Holder,” that is, the individual person who is assigned the email address corresponding to the winning entry.
9. Limitations of Liability and Release: No liability or responsibility is assumed by Sponsor or Promotion Parties resulting from participation in or attempt to participate in the Promotion or download any information in connection with participating in the Promotion. No responsibility or liability is assumed by the Sponsor or Promotion Parties for technical problems or technical malfunction which may affect the operation of the Promotion, including but not limited to any of the following occurrences: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent to or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Twitter, Instagram and/or Wisconsin Travel Best Bets Site, in whole or in part for any reason; traffic congestions on the Internet or the Instagram, Twitter and/or Wisconsin Travel Best Bets Site; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Promotion, or loss, misdirection, inaccessibility or unavailability of an account used in connection with the Promotion. Sponsor is not responsible for any typographical errors in the announcement of Prizes or these Official Rules, or any inaccurate or incorrect data contained on the Twitter, Instagram and/or Wisconsin Travel Best Bets Site. Use of the Twitter, Instagram and/or Wisconsin Travel Best Bets Site is at user’s own risk. Sponsor and the Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer equipment resulting from participation in the Promotion, use of the Twitter, Instagram and/or Wisconsin Travel Best Bets Site or the download of any information from the Twitter, Instagram and/or Wisconsin Travel Best Bets Site. By participating in the Promotion, the entrant agrees to resolve any dispute individually, without resort to any class action. By accepting a prize in the Promotion, winners agree that the Sponsor and Promotion Parties shall not be liable for any loss or injury resulting from participation in the Promotion or acceptance or use of any prize.
BY PARTICIPATING IN THE PROMOTION, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR AND THE PROMOTION PARTIES AND INSTAGRAM AND TWITTER FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH. EACH PARTICIPANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE PROMOTION PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE PROMOTION, AND IN NO EVENT SHALL SPONSOR, THE PROMOTION PARTIES OR INSTAGRAM AND TWITTER BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES AND EACH PARTICIPANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER.
